Tras mas de 4 años desde que salio a la luz la manipulacion por medio de Throttling
y traffic shaping al programa de descarga torrent, ahora se vuelve a confirmar otra
practica ilegal por parte de el provedor de internet C&W Panama para registringir la
velocidad de descarga de sus usuarios, y una vez mas nos deja sorprendidos el nivel de
descaro con el cual se lleva acabo ya verificado desde hace mas de 4 meses la restriccion
de casi 95% de la velocidad total a la cual tiene sometidos a todos los clientes de adsl
que son la gran mayoria del pais.
Especificando desde las 9am hasta las 9pm de lunes a sabado las descargas por torrent
como tambien de los servidores de rapidshare (premium como free) estan regulados arbitrariamente
por parte de esta compañia convirtiendo su propaganda de internet ilimitado en una falacia.
Hemos empezado una campaña para que esta denuncia llegue mas alla de su pobre callcenter (sitel)
empresa externa a C&W y que hasta ahora ninguna respuesta ah podido dar al asunto.

Hasta ahora confirmado el torrent y rapidshare estan siendo regulados, independientemente si tienes
1mb o 4mb durante el dia no bajas a mas de 5 kbps, inclusive con cuentas premium. Y nos preguntamos,
alguein con mas de 1mb de velcidad en su casa ilimitado y que durante 12 horas del dia solo pueda
usar el 10% de su velocidad y que llame al 800-5555 y le digan que el problema es su computadora,
o virus, o su red, o cualquiera de las escusas que dan como se ah de sentir al enterarse de esto.

Al que tenga opcion que se cambie a cableonda, los que no la tenemos a quejarnos todos y a hacer que
los tecnicos de soporte de Sitel busquen en google q es traffic shaping y throttling, por que C&W sigue
vendiendo su red, pero si no amplian su ancho de banda que ya esta saturado que clase de servicio planean
brindarnos.

Hagan la prueba:
Nocion basica: la velocidad con que deben bajar cualquier cosa de internet es lav elocidad que contratan
dividida entre 8, o sea que si contratan 1mb (1024kbps) / 8 deben bajar a 128kbps teorico
pero realmente en una coneccion saludabe debe fluctuar entre 100kps y 112kbps. y asi , si
en su casa u oficina tienen 2mb deben bajas a 200kbps, 3mb bajan a 300kbps etc.

Les dejo un link para q prueben durante el dia y despues durante la noche, esta coneccion en modo free debe darles
minimo 100kbps y premium minimo 500kbps pero con el filtro de C&W durante el dia no sube de 10kbps al igual q el
torrent. Igual los exorto a probar otros servicios durante el dia y despues en la noche, o sea de 9am a 9pm y despues de
esas hora de lunes a sabado es el bloqueo.

Daño de CW deja a 2 mil 100 líneas fijas sin servicio


Las lineas son de propiedad de CW, la cual cobra una mensualidad a sus miles de usuarios.  El articulo 1644 del Codigo Civil dispone que "aquél que causa daño a otra persona sea mediante acción u OMISIÓN es responsable por dicho daño y debe compensar a la actora por las lesiones y daños sufridos".

Quien responde ante los usuarios por los daños causados?  El fabricante del cable? El fabricante de la tubería de agua?  La persona que instaló cada uno?   El que cobra el servicio al usuario?

Un daño en el cable de la central telefónica 224 de Cable & Wireless (C&W), ubicada en Río Abajo, dejó ayer fuera de servicio a aproximadamente 2 mil 100 líneas de telefonía fija.

El daño se debió a que se introdujo agua en el empalme del cable que tiene 3 mil pares aislados con papel, informó Abraham Coronado, jefe de la cuadrilla de C&W que realiza la reparación.

Se tienen que reemplazar 275 metros de cable subterráneo, por lo que algunos clientes estarán sin el servicio durante varios días. Existe un mecanismo para reconocerle a los clientes en la facturación el tiempo que se quedaron sin el servicio telefónico, dijo Coronado.

María Trinidad Cornejo revienta de furia cada vez que se acuerda de una deuda pendiente que tiene con una telefónica y que según ella ha sido un descuido administrativo por parte de la empresa que no gestionó el cobro.

A sus manos jamás llegaron estados de cuenta. Tampoco recibió llamadas que la alertaran de una deuda, pero cuando consultó sus referencias en la Asociación Panameña de Crédito (APC) descubrió una cuenta pendiente de 283 dólares, a punto de cumplir un año.

"Mi historial de crédito se dañó, a pesar de que pago a tiempo mi préstamo de auto y tarjeta de crédito. Cuando gestione mi hipoteca, las malas referencias me afectarán", dijo preocupada Cornejo.

Así como ella, hay otros panameños que quedan sorprendidos cuando observan su estado de cuenta con alguna de las compañías que prestan el servicio post pago de telefonía celular.

Es común escuchar a los clientes quejarse de que les contabilizaron llamadas que dicen no haber hecho, que no se les notifica de un excedentes al cerrar un contrato o que le siguen cobrando una mensualidad cuando suspendieron el servicio.

En un sondeo, no científico, realizado en el sitio www.prensa.com, el 34% de los consultados está molesto por la mala atención que prestan las telefónicas, el 25% se inclina por problemas en la facturación, 24% en cobertura y un 17% en aspectos de servicios.

"Siempre me han facturado de más. Desde que hice mi contrato con Movistar todos los meses he tenido que ir a reclamar por errores en la factura en contra mía", dijo una de las consultadas.

Este medio trató de buscar una reacción por parte de Movistar (Telefónica Móviles de Panamá), pero no hubo respuesta.

Otro quejoso manifestó que estaba cansado de que cuando tiene algún problema le "coloquen una grabadora" y no a un operador de inmediato cuando llama a la compañía que le presta el servicio.

El director Nacional de Atención al Usuario de la Autoridad Nacional de los Servicios Públicos (Asep), Herbert Sedelmeier, indicó que si los usuarios sienten que hay un cargo que no les parece correcto tienen todo el derecho de reclamar.

Pero su mejor consejo es que se use comedidamente el servicio y con responsabilidad.

"Los celulares son para comunicarse y no para hacer sociales", afirmó el funcionario, tras advertir que el servicio no es barato y cuando vienen las cuentas "astronómicas" siempre hay molestias.

La Asep informó que del 100% de los reclamos que recibió esta entidad el año pasado, el 18% fue en el área de telecomunicaciones, lo que representó 271 casos.

Reclamos por alto consumo abarcaron un 16% de las quejas, mientras que el servicio móvil y el roaming en conjunto sumaron otro 16%, seguido de larga distancia (15%).

Otras reclamaciones (41%) pueden incluir televisión pagada, servicio de internet e incumplimiento de contratos.


Saldo de $22.4 millones en cuentas nuevas

La telefonía celular concentra su masa crítica de clientes en el segmento de prepago.

Los usuarios que se manejan a través de un contrato son los menos, pero su peso es importante. La Asociación Panameña de Crédito (APC) reveló que las compañías de telecomunicaciones reportaron 41 mil 905 nuevas cuentas por el servicio de celular pospago, de enero a diciembre de 2009.

Ello reflejó un incremento de 60% en comparación con el mismo periodo de 2008, cuando ingresaron 26 mil 258 cuentas.

"Este incremento de más de 15 mil créditos se debe a la apertura del mercado de la telefonía celular, que permitió la entrada de nuevas compañías a nuestro país", destacó la APC en un informe.

La APC señala igualmente que estas compañías reportaron un saldo en nuevas cuentas de 22.14 millones de dólares en 2009, un incremento de 12% con respecto al mismo periodo del año anterior.

desde su propio dominio, pues utilizaban como
"relay" o SMTP saliente: cwpanama.net. Con la
nueva actualización de la plataforma de correos
residencial, la opción de "relay" no es soportada.

Queremos por este medio reiterarles a ustedes,
nuestros clientes corporativos que las buenas
prácticas de manejo de correos recomiendan
utilizar su propio dominio como SMTP saliente en
cada una de sus computadoras.

Al utilizar su propio dominio como SMTP de salida, usted:
Crea buena reputación de su propio dominio antes
otros operadores y usuarios de Internet
No se afecta si el dominio "relay" cae temporalmente en listas negras
No se ve afectado en el envío de correo por
cualquier evento, mantenimiento, o inconveniente
que tuviera el dominio cwpanama.net.


Recomendamos, que su técnico de TI/sistema, tome
algunos minutos para cerciorarse que cada una de
las computadoras en su empresa tiene definidos
correctamente los SMTP saliente y entrante para
evitar los inconvenientes que hemos detectado en algunos pocos clientes.

The problem is that cwpanama.net is probably blacklisted and you are
going to need to talk to them to see if they have an authenticated and
/or secure smtp server or move your internet connection to a company
that does. In the meantime, you should be able to send stuff out via
webmail if you have that facility with gate.com, or with some other
email provider.

It's called ub 8.04 - the 8 is for 2008 and the .04 is for April. Next
will be 8.10.

You haven't yet described how you are using Tbird for mail -- what
mailservers and what configuration.

'It will not send' is not informative. Is the smtp server smtp auth?
Does it require a SSL connection? Where are you getting your information
for how you are to configure for the smtp server.

There is not a 'generic'/standard spamfilters in the US. Every spamfilter
is configured. Some people use their provider's filter which isn't
particularly configurable. As a general rule, if your recipients
whitelist your mail it shouldn't be considered spam.

One major cwpanama.net output server is static.cwpanama.net which is
blocklisted quite a few places for hitting spamtraps and such.

If you use the same output server as is used to output spam, you are going
to run into filter problems.

You haven't yet told us what you are trying to work around re gate.com
smtp.

If a mailserver rejects the mail from a blocklisted IP before it ever gets
to a point where it can be whitelisted at the request of a client, then
the client has no control of the rejection process.

"it will not send" means what? Does the computer catch fire? Are
you receiving an error message? What mail tool or application are you
trying to use? Which port are you trying to send to, 25 or 587?
From what address range? Does the remote system send any error message?

The spam filters, whether in the US, or anywhere else in the world,
are run by individual ISPs, as well as by individual people. Not all
of LACNIC is blocked, but it does have a pretty horrible reputation.

That depends on what the problem is, and you have not told us what
that problem is - what error message you get.

That is one of the recommended solutions - the other is to use an
external relay that isn't on the various blocklists for spam and other
mail or network abuse.

Check to see if your IP (the IP you used to send e-mail which is being
blocked) is listed by one of the RBL (Real-time Blackhole List) providers.

My Ongoing War with Clueless and Worthless

Sometimes known as Cable and Wireless (they put it on their bills) Panama's premier telecommunications company has few admirers and deservedly so. Observing some of their actions prompts the question "Is there any Intelligent Life at Cable and Wireless?" A recent example; I and several friends began having email problems a few months ago. We could receive email just fine, but could not send messages out. The only thing we all had in common was that our email servers are located outside Panama. There were several @panamaretire.net accounts and a @panamamasons.net account. The temporary fix was to use the online mail programs instead of Thunderbird, Evolution, or Outlook. After a lot of head-scratching and trouble-shooting, my friend John called the C&W "help" desk and they eventually told him that they are blocking all SMTP server traffic (this is the server that forwards your outgoing email) if the server is not located in Panama, and the solution is to use the C&W SMTP server. The explanation was that they are trying to control SPAM. This is, needless to say, totally BOGUS. I have a lot of email accounts and the ONLY one that regularly receives more than one or two SPAM messages is my @cwpanama.net account. I think it a lot more likely that the only way they can monitor all outgoing email is to make sure it goes through their servers. Not too sure about who might be forcing this, but I have my suspicions.

Back to the point, one of my clients has been using a foreign email server for years, and when I tried to set up their @cwpanama.net address in the SMTP account, it wouldn't work. A call to C&W found that they had discontinued the account, and to get it turned back on, my client had to submit a written request signed by the legal representative. Well, that took several days, but finally the new password was issued. It was a six-digit sequential number, which to a black hat hacker is no password at all. OK, let's log in and change the password. No cigar, there is no option in the C&W online email program to change the password. My client called the "help" desk and asked how to change the password and was told they would have to submit another written request, signed by the legal representative. At this point, client went postal, questioning their IQ and ancestry, and screamed at them. When the client calmed down, they finally admitted that there was a URL where the password could be changed. Now, in all my trying to find a password changing operation, I looked at every cwpanama.net address I could find, but it turns out that the password program is hidden away at cwpanama.com! I'm curious to know how many of their customers have never bothered or been able to change the default password because they didn't know that you have to go to cwpanama.com to change it. BTW, just as a matter of interest, they also use a default password on most of their ADSL modems. A black hat could have a field day on the Clueless and Worthless network.

Estimado cliente de Webhosting compartido:


Con el propósito de mejorar la calidad del servicio que le brinadmos en nuestro producto de webhosting compartido,
hicimos en dias pasados una actualización del software en el servidor de correos.


Aprovechamos la oportunidad para recordarles las buenas prácticas de uso de sus correos de manera
que todos los usuarios que comparten este servidor se vean beneficiados con su uso correcto y se
evite lentitud en el servicio:
1) Baje regularmente los correos alojados en nuestro servidor compartido a su computadora. No los
almacene por tiempos largos en nuestro servidor; eso recarga el servicio y hace que su acceso sea
lento cada vez que baja o envía correos.


2) Configure su cuenta de correo para que sincronice con nuestro servidor cada cinco minutos y no a
cada segundo. Esto permitirá al servidor está más holgado para manejar otros procesos.


3) Revise la capacidad de su plan contratado y verifique que la suma de sus cuentas de correos no excede
el espacio contratado. Para ayudarlo en su control individual, hemos configurado cada buzón con
el estándar recomendado por nuestro proveedor con un tamaño de 20 Megas por usuario, más capacidad
que el plan contratado.


* Para su referencia, el plan más sencillo que ofrecemos tiene 50 Megas y comprende 10 cuentas de correos;
si usted divide 50 megas entre 10 cuentas le da un tamaño máximo de 5 Megas por buzón.
* Nuestro plan actual más grande tiene 600 Megas en capacidad y comprende 50 cuentas de correo; si usted
divide 600 Megas entre 50 cuentas le da un tamaña máximo de 12 Megas por buzón.


4) Recuerde que nuestra plataforma actual sólo permite envío/recepción de adjuntos con tamaños menores
a 5 Megas. Si su necesidad actual es mantener comunicación con adjuntos mayores a ese tamaño,
le aconsejamos consultar con su vendedor(a) en Cable & Wireless para ver el producto Hosted Exchange
que permite tamaños en adjuntos de hasta 10 Megas y configuración de buzones individuales con mayores
tamaños al de 20 Mega.


5) Los mensajes SPAM son una realidad con la que debemos vivir hoy en día todos los usuarios de Internet.
La nueva actualización le permitirá configurar de manera individual algunos filtros para minimizar
estos mensajes. Nuestra empresa ofrece también algunos productos de antivirus, antispam y de seguridad
(firewall) que podrían ayudarlo a minimizar aún más la recepción o intromisión de este tipo de mensajes.

Cable & Wireless Panama S.A. (“Cable & Wireless Panama”), a subsidiary of Cable & Wireless, is the incumbent operator and provides domestic and international voice, data and IP services to residential and business customers in Panama. Cable & Wireless Panama is the largest telecommunications company in Panama.
The telecoms market in Panama has been liberalising since 2003. International and domestic fixed line services are now fully liberalised, whilst Cable & Wireless Panama operates in a duopoly in the mobile market (with Telefonica) until 2008. Competition in fixed line voice services is concentrated in international and long distance services with 56 and 32 operators licensed in each segment, respectively. IP services have been liberalised for many years with 84 licensees.
In light of the increased competition and in line with customer demand Cable & Wireless Panama continues to focus on the development of its mobile and IP capabilities as well as maintaining high standards in customer service and retaining its market leading position in fixed line services.
In the year to March 2005, Cable & Wireless Panama continued its investment in GSM services to enable an expansion of capacity in order to meet the increase in demand for its services. Total mobile customers increased to 634,000 at 31 March 2005, an increase of 25 per cent over the prior year.
Cable & Wireless Panama has also invested in DSL services in the year. This investment has enabled the launch of a range of bundled IP solutions for business as well as an increase in access for residential customers. At the 31 March 2005, DSL customer numbers were 38,000 an increase of over 123 per cent in the year.
During the year to March 2005, Cable & Wireless Panama has continued to focus on retaining its market leading position in fixed line. Activities have focused on customer service improvement and customer retention. Fixed line customers in Panama have increased from 360,000 at 31 March 2004 to 383,000 at 31 March 2005.




Claim against the Minister of Finance and Economy, Panama


On 16 December 2002, a complaint was filed by two Panamanian lawyers exercising a public action at the Third Chamber of the Supreme Court of Justice of Panama questioning the law governing and rules of Public Bid No. 06 96 won by INTEL, S.A. (now Cable & Wireless Panama, S.A.). Complaints filed at the Third Chamber of the Supreme Court of Justice must be filed against the public officer who enacted the relevant regulation or act. This complaint was filed against the Minister of Finance and Economy in Panama specifically alleging that the Operating Agreement executed between Cable and Wireless (CALA Management Services) Limited and INTEL, S.A. (now Cable & Wireless Panama, S.A.) as part of the privatisation agreements was null and void ab initio, on the grounds that it had not been published in the Official Gazette in Panama.
The Operating Agreement enables Cable & Wireless Panama, S.A. to use the technical and management know-how of Cable and Wireless (CALA Management Services) Limited to fulfil more effectively its obligations under the concession granted to it by the Government of Panama to install, operate and exploit telecommunication services in Panama. Cable & Wireless Panama, S.A., due to its close interest in the outcome of the complaint, requested recognition by the Court and permission to participate in the proceedings. The Court agreed to this.
On 21 March 2003, the Court permitted the claim to proceed. Cable & Wireless Panama, S.A. filed an appeal against the admission of the claim to proceed, however the Court confirmed its decision to permit the claim to proceed on 17 March 2004.
As required by Panamanian law, the Administrations General Attorney has provided an opinion to the Court in defence of the law or regulation, which is the subject of the complaint. The Administrations General Attorney has opined that the Operating Agreement complied with all the requirements established by the law and by the rules of Public Bid No. 06 96 and was countersigned by the General Comptroller acting with due authorisation.
On 1 April 2005, Cable & Wireless Panama, S.A. tendered its response to the claim and submitted evidence for consideration by the Court. The plaintiff has requested that the effect of the Operating Agreement be suspended temporarily – an issue which the Court rejected on 10 March 2005. On 7 September 2005, the submission of evidence before the Court was completed. The Court is currently waiting to hear closing arguments.


Panamanian counsel considers this claim to be without merit and none of Cable and Wireless plc, Cable & Wireless Panama, S.A. or Cable and Wireless (CALA Management Services) Limited is party to the complaint. If the complaint were to be successful, the concession under which Cable & Wireless Panama, S.A. operates would not be affected. However the Operating Agreement could be declared null and void and then the complainants could file a complaint against Cable and Wireless (CALA Management Services) Limited requiring the return of all management fees collected under the agreement since its execution on 20 May 1997. This would amount to approximately £60 million. In the event that this complaint should be successful, Cable & Wireless and its subsidiaries intend to vigorously pursue any legal recourse available to them.



Telecarrier Inc. vs. Cable & Wireless Panama, S.A.


On 5 May 2004, Telecarrier Inc. lodged a claim in the Sixth Circuit Civil Court of Panama alleging non-compliance by Cable & Wireless Panama, S.A. (“Cable & Wireless Panama”) with the Interconnection Agreement between the parties in connection with the invoicing and collection process. Telecarrier Inc. requested the Court to order the continued provision of a pre-determined billing and charging process and to prevent Cable & Wireless Panama from using an alternative process. They also claimed US$18 million (£9.6 million) damages and costs.
On 9 September 2004, Cable & Wireless Panama submitted a defence to the claim and on 30 December 2004, the parties presented a petition for suspension of the process for a period of 45 days to allow them to negotiate with each other. In a resolution dated 30 December 2004, the Court admitted the petition and negotiations with the plaintiff were initiated. The suspension period has expired. Negotiations between Cable & Wireless Panama and Telecarrier Inc. concluded and no agreement was reached. The Court re-opened proceedings on 13 May 2005. The process is pending the submission of evidence to the Court. On 25 August 2005, Telecarrier Inc. petitioned the Court to join the unjust enrichment claim brought by Cable & Wireless Panama with its non-compliance claim against Cable & Wireless Panama discussed above.
In a separate action, on 25 August 2004, Cable & Wireless Panama lodged a claim against Telecarrier Inc. in the Seventeenth Circuit Civil Court of Panama claiming unjustified enrichment by Telecarrier Inc. through the use of Cable & Wireless Panama’s fixed telephone network to allow the rerouting of traffic for internet public use. Cable & Wireless Panama is claiming US$14 million (£7.5 million).
The claim was admitted by the Court on 2 September 2004. On 23 December 2004, the parties agreed to suspend the process for a period of 30 days to allow for a period of negotiation – a move endorsed by the Court on 23 December 2004. Negotiations between Cable & Wireless Panama and Telecarrier Inc. concluded and no agreement was reached. The proceedings are pending the submission of evidence before the Court.

Litigation with Cibertec International, S.A. and Inversiones Kamasu, S.A.
Cibertec International, S.A. and Inversiones Kamasu, S.A. initiated proceedings against Cable & Wireless Panama, S.A. and Cable and Wireless (CALA Management Services) Limited in Panama on 29 October 1999. The claim is for approximately US$125 million and alleges breach of contract. On 18 November 2002, the Panamanian Circuit Court handed down a decision against Cable & Wireless Panama, S.A. awarding damages of US$67,255,000, including moral damages and costs. The Court decided that Cable & Wireless Panama, S.A. had failed to maintain in sufficient confidence certain of the proprietary information of the plaintiffs.
Cable & Wireless Panama, S.A. appealed the judgement on 3 December 2002 and intends to pursue this appeal vigorously. Pending the resolution of its appeal, Cable & Wireless Panama, S.A. is not obliged to pay, and has not paid, any of the awards against it.

The Register's Bill Ray reports that Digicel is suing rival Cable & Wireless for "engaging in illegal and uncompetitive practices which delayed Digicel's expansion into Caribbean markets and cost the company hundreds of millions of pounds."
"Between 2002 and 2006, Cable & Wireless has been accused of refusing to interconnect with Digicel customers in various countries, as well as charging unreasonable termination fees once interconnections were established," Ray writes. "In some countries the government has been forced to step in and set termination fees, as well as mandating interconnection."
In response, Ray says, Cable & Wireless "has dismissed the claims as a 'spoiling tactic' that has no foundation."

LONDON, England (Bloomberg): Cable & Wireless Plc, the UK's second-biggest phone company, is being sued by Digicel Group Ltd., a Caribbean and Central American telecommunications operator owned by Irish billionaire Denis O'Brien.

The company filed a lawsuit on Thursday against Cable & Wireless at the High Court in London, Digicel said in an e-mailed statement. The company alleges Cable & Wireless impeded its entry into telecommunications markets in the English-speaking Caribbean.

"We are extremely frustrated with the continual illegal obstructions that we have encountered from C&W," Digicel's O'Brien said in the statement. The company is seeking "several hundreds of million of pounds" in damages.

The lawsuit alleges Cable & Wireless tried to prevent the company from starting competing mobile-phone networks in St Lucia, St Vincent & the Grenadines, Grenada, Barbados, the Cayman Islands, Trinidad & Tobago and the Turks and Caicos Islands. The obstructions took place between 2002 and 2006, the statement said.

Cable & Wireless said it will "vigorously" defend itself. "We have received an unspecified claim this morning," Cable & Wireless said in a statement read by outside spokesman James Wyatt-Tilby. "We don't believe it has any foundation."

HIGH COURT ACTION BY DIGICEL AGAINST CABLE & WIRELESS OVER UNLAWFUL BEHAVIOUR .



LONDON, UK, 19 July 2007. Digicel Group Ltd (“Digicel”), the fastest-growing wireless telecommunications operator in the Caribbean and new entrant to the Central American market today issued a claim in the English High Court against Cable and Wireless plc (“C&W”) and various of its subsidiaries, seeking multi-million pound damages.
Digicel claims that C&W was engaged in illegal behaviour by impeding and delaying Digicel’s entry into various telecommunications markets in the English-speaking Caribbean.
Digicel also believes that it has been the victim of a co-ordinated effort on C&W’s part to prevent and delay Digicel launching competing mobile telephone networks in St Lucia, St Vincent & the Grenadines, Grenada, Barbados, the Cayman Islands, Trinidad & Tobago and the Turks and Caicos Islands.
The obstructions and delays by C&W, between 2002 and 2006, have resulted in substantial damages and as a result Digicel’s claim covers:
Losses of revenue, profits and market share;
Restitutionary damages from C&W for the gains and benefits made by C&W as a result of its unlawful conduct and;
Exemplary damages (compensation in excess of actual damages) and interest.
The damages sought by Digicel should amount to several hundreds of millions of pounds.
It is expected that the claim will come to the High Court in 2008.
Commenting on the claim Denis O’Brien, Chairman of Digicel said; “We are extremely frustrated with the continual illegal obstructions that we have encountered from C&W. We believe that a successful claim will not only compensate Digicel for the losses it has suffered but also that it will put an end to the anti-competitive practices of C&W. This will be of undoubted benefit to all network operators and more importantly all mobile users in the Caribbean.”

Background:
For mobile telephone services to be provided by a new provider, it is necessary for them to ‘interconnect’ with any existing telecommunications provider operating a public telecommunications network in a territory.This is a physical process between two networks, without which customers of one network cannot call customers of another network. Local telecommunications legislation in the territories generally provides that any telecoms provider shall not refuse, obstruct or in any way impede another provider from making an interconnection.
In 2000 Digicel identified an opportunity in the Caribbean telecommunications market at a time when liberalisation and the introduction of competition across the region were underway.
Digicel particularly identified a potentially lucrative opportunity in the mobile telephone market in the Eastern Caribbean region because there was a low take-up of mobile phones within the residential population and Digicel was able to offer more modern technology and a better service than the monopoly provider, C&W.
Digicel recognised that a quick launch into the new market was important to coincide with the peak time for acquiring mobile phones (Christmas) and to attract new potential subscribers.
In 2000/2001 Digicel launched its mobile telecoms business in Jamaica very successfully, acquiring the necessary licence and achieving interconnection, albeit after experiencing some initial resistance from C&W, who until then had enjoyed a monopoly as sole provider. Digicel established its new GSM mobile network rapidly and achieved a high degree of market share very quickly.
Planning to expand into countries affiliated with the Organisation of Eastern Caribbean States (OECS – St Lucia, St Vincent & the Grenadines and Grenada) and Trinidad & Tobago, Barbados and Guyana, Digicel created operating subsidiaries in the territories identified above with a view to obtaining licences or concessions to operate mobile telecoms networks on these islands.
In the period from 2002 to 2006, Digicel was awarded licences to establish mobile telephone services in the territories which are the subject of this claim, and in each case immediately started the process to facilitate interconnection with C&W.
Without exception, in each territory, Digicel experienced resistance and obstruction from C&W. Indeed, in 2002 an internal strategy document produced by C&W revealed that C&W was intentionally delaying Digicel’s entry into these markets for as long as possible.This strategy, and the actions it gave rise to, clearly breached C&W’s statutory duties.
In St Lucia the launch by Digicel was delayed from before Christmas in 2002 until late March 2003; in SVG the launch was delayed by over 6 months; in Grenada it was delayed by 5 months; in Barbados by over 6 months; in Cayman by over 2 months; in Trinidad & Tobago by at least 4 months and in Turks and Caicos the launch was delayed by over 3 months.
Aside from lost market share and future profits, Digicel lost revenue from call charges and interconnection fees payable by C&W in respect of inter-network calls originating on C&W’s networks, costs and expenses arising from the unlawfully protracted process of interconnection in each territory, costs and expenses arising from the delayed launches, and lost management and staff time dealing with C&W’s unlawful behaviour.The claim is expected to total some hundreds of millions of pounds.

Cambio de software webmail


CW ha cambiado el software de servidor webmail a sus usuarios esta semana, sin previo aviso alguno. El cambio coincide con problemas de envio en correos desde los servidores CW, que se han reportado al proveedor sin recibir más respuesta de que "debe ser el Outlook".

El nuevo software es IPSWitch IMail Server Web Messaging descrito como "una comprobada tecnología de mensajería, con la cual son enviados diariamente miles de millones de correos electrónicos por todo el mundo entre más de 60 millones de usuarios".

Ente Regulador acepta reclamo contra CWP por usuario

Un usuario comercial presentó un reclamo contra CWP ya que un tercero habia interceptado la cajilla telefonica en las áreas comunes del edificio del usuario y habia hecho llamadas por cobrar. El usuario avisó a CWP de esta regularidad pero siguieron facturando, por lo que se cambió de proveedor de telefonía y presentó el reclamo ante la oficina de Atención al Usuario del entonces Ente Regulador (hoy Autoridad de Servicios Públicos). A pesar del monto, el Ente aceptó el reclamo, al cual CWP se opuso. Con un escrito como el sigue, el abogado del usuario explicó los fundamentos legales para el reclamo:

...acudimos ante el despacho a su digno cargo a fin de interponer OPOSICION CONTRA LA APELACION de CABLE & WIRELESS PANAMA, S.A., contra la Resolución OAC-T-12XXX de 14 de febrero de 2005 por la cual se acepta reclamación por USUARIO, S.A., en contra de CABLE & WIRELESS PANAMA, S.A.
Fundamentamos nuestro escrito en los siguientes hechos:
PRIMERO: Para la fecha del reclamo existe un largo historial de reclamos en contra de las prácticas ilegales de facturación indebida por parte de CABLE & WIRELESS PANAMA, S.A. Constan en los archivos del Ente el reclamo XX, el cual se origina en cartas desde el 2 de julio de 2004, a la Jefe de Servicios Administrativos de CABLE & WIRELESS PANAMA, S.A., Katia M. Alvarado.
SEGUNDO: Ha sido reportado a CABLE & WIRELESS PANAMA, S.A. las violaciones por parte de terceros al sistema de líneas de USUARIO, sin que hasta el momento CABLE & WIRELESS PANAMA, S.A., tome las medidas del caso. USUARIO ha tomado las medidas para que personas dentro de su empresa no abusen de las llamadas, pero CABLE & WIRELESS PANAMA, S.A., no ha tomado medidas para que terceros intercepten las líneas ubicadas fuera de USUARIO.
TERCERO: USUARIO, S.A., (en adelante USUARIO) es cliente del servicio de telefonía de CABLE & WIRELESS PANAMA, S.A., (en adelante CWP), quien Cable & Wireless para los meses de junio y julio de 2004, hizo una facturación extraordinaria en la facturación correspondiente a esos meses, productos de llamadas de "valor agregado" y a "celulares" en horario no laborables de USUARIO; lo cual hace presumir que no fueron hechas desde las oficinas de USUARIO.
CUARTO: USUARIO presentó los reclamos correspondiente a los meses de junio y julio 2004, a lo cual CWP procedió a realizar las investigaciones donde CWP pudo comprobar que las cajillas que están en el sótano del edificio Torre XXX tenían rastros de que habían sido peladas (pinchadas), pero a pesar de este hallazgo no aceptan reconocer los reclamos de USUARIO.
QUINTO: Al cambiar varias líneas telefónicas de USUARIO de CWP hacia la empresa [COMPETIDOR DE CWP], las líneas que usaba USUARIO con CWP fueron sacadas de nuestra central y del local de USUARIO.
SEXTO: En carta GSME-512-04-1-C-3484 de 14 de julio de Victor Martínez C. de CWP, informaron que tras investigación NG00986 se encontró que “los cables que servían estas líneas se encontraban pelados.” Si bien dichas líneas se encuentran en áreas de uso común del edificio en la Planta Baja que se encuentra detrás de una puerta trancada, CWP no ha tomado medida alguna para evitar que se entre violen las cajillas de las lineas.
SEPTIMO: La empresa CWP ha facturado indebidamente a USUARIO la suma de SEISCIENTOS NOVENTA Y NUEVE BALBOAS CON SESENTA Y SEIS CENTAVOS (B/.699.66).
OCTAVO: Al facturar la suma de SEISCIENTOS NOVENTA Y NUEVE BALBOAS CON SESENTA Y SEIS CENTAVOS (B/.699.66) - a que hace referencia la Resolución OAC-T-12XXX - contra la empresa USUARIO, quien no ha efectuado fraude en uso de los servicios de teléfono, CWP ha incurrido en violación del Artículo 33° de la Resolución No. JD-101 de 27 de agosto de 1997:
Artículo 33° : … el prestador del servicio no podrá ni cobrar como parte de la prestación del servicio, ni suspender éste por la falta de pago de la compensación pecuniaria por los daños ocasionados, con excepción de la compensación que corresponda por daños ocurridos como consecuencia directa de fraude comprobado en la utilización del servicio.”
Así como de los Artículos 245 y 246 del Decreto Ejecutivo 73 de 1997:
Artículo 245. Los concesionarios deberán facturar a sus clientes en forma actualizada y correcta, debiendo reflejar separadamente los cargos correspondientes a cada servicio.
“Artículo 246. Los concesionarios sólo deberán utilizar equipos e instrumentos de medición y registro de alta precisión y confiabilidad para la facturación.
"
NOVENO: CWP ha facturado indebidamente a USUARIO SEISCIENTOS NOVENTA Y NUEVE BALBOAS CON SESENTA Y SEIS CENTAVOS (B/.699.66) por actos ilícitos cometidos por personas distintas a USUARIO y que violan los Artículos 56.2 (conexión de equipos terminales, sin la autorización correspondiente) y 56.3 (ocasionar interferencias o intercepciones a los servicios de telecomunicaciones como consecuencia de conexiones no autorizadas, o debido a dolo) de la ley No. 31 de 1996 y el Artículo 258 (se prohibe cualquier interferencia a la integridad de las transmisiones no justificada o cualquier intercepción indebida de las mismas).
PRUEBAS: Aducimos como pruebas:
1) Copia de carta GSME-512-04-1-C-3484 de 14 de julio de Victor Martínez C. de CWP, sobre investigación NG00986.
Aducimos como fuente de pruebas los archivos de [COMPETIDOR DE CWP] y CWP relacionados con los contratos que mantienen con USUARIO.
SOLICITUD: Por lo anterior solicitamos se CONFIRME la Resolución OAC-T-12XXX de 14 de febrero de 2005 y se ordene a CWP a acreditar la suma por cargos indebidos por valor de SEISCIENTOS NOVENTA Y NUEVE BALBOAS CON SESENTA Y SEIS CENTAVOS (B/.699.66) como dispone la Resolución.

Digicel 'showing' up Cable and Wireless' in the Barbados Telecom market

A Barbadian businessman who is partnering with Digicel says the fact that Cable and Wireless in Barbados is planning concessions to local consumers highlights that company's indifference to consumer needs in the past.

This is the contention of Ralph "Bizzy" Williams, in response to revelations by C&W's chief executive officer, Donald Austin that the telecommunications giant would soon be offering attractive incentives to local consumers. Some of these include cheaper phones, per second billing and calling-party-only-pays rates, according to the Barbados Nation newspaper.

Williams, who is a member of local consortium, Warrens Telecoms, in partnership with Irish telecommunications provider, Digicel, told the Nation the competition which Digicel was bringing to the market was exposing how Barbadian consumers had been treated in the past.

"Monopolies tend to cripple the consumer and local consumers have suffered in the past because Cable & Wireless controlled the market. Digicel's entry into the Jamaican market shook up Cable & Wireless and consumers benefited.

Now they have to wake up herein Barbados," Williams was quoted as saying.

He indicated that the reason he had joined with Simpson Motors' Kyffin Simpson in Warrens Telecoms was due to the importance of communications to the success of their businesses.

"Our businesses depend on efficient, clear and reliable communications. That is why, before there were cell phones, you would see everyone with a radio. But we can't use cell phones at the current rates. They are simply too expensive.

"We are hopeful that Government will give us the licence and opportunity to compete on the local market. Businesses in Barbados, and the average consumer, will benefit fromDigicel's presence," he argued.

Williams also conjectured that C&W's major involvement in the sponsoring of sporting activity in the region might have led to limited focus being previously paid to the very lopsided relationship it enjoyed with Barbadian consumers.

However, the C&W chief, in dismissing Williams' comments, said his company's incentives were not a response to the competition from Digicel, but a process that had started long before the advent of that telecommunications company.

Austin indicated that C&W had been reducing rates, including its Internet and international mobile rates, in response to what has been happening on the worldwide market.

MAY I through the medium of your column congratulate Cable & Wireless for their consistency in the service provided to their customers.

On 24th September, 2004, I reported that two business lines had been out of service since 22nd September.

Ten working days after that report they are still out of service. Congratulations Cable & Wireless you have maintained your position of total indifference to your obligations to your customers.

Indeed the significant progress you have made in the last three years in providing wrong information in recorded messages that numbers (which are in fact in service) are not in service and that numbers which are not long distance numbers are long distance numbers.

No doubt the customer pays for this. Keep up the good work! Please do not lay any blame at the feet of Hurricane Ivan. The present problem arose as a result of a truck damaging the telephone cable in the area of Duke and Tower streets on September 22, 2004.
